Rule 23(b)(3) Settlement Class Party Exclusion

The class includes all entities that accepted Visa or Mastercard cards in the United States from January 1, 2004 to January 25, 2019, except that the Rule 23(b)(3) Settlement Class shall not include the following parties:

• The U.S. Government: The United States government is not eligible.
• Visa and Mastercard: The companies themselves and their affiliates are excluded.
• Financial Institutions: Banks and other financial institutions that issued cards or acquired Visa and Mastercard transactions during this time period are not eligible.
• Dismissed Plaintiffs: Plaintiffs that previously settled and dismissed their lawsuit against a Defendant, and entities related to those plaintiffs. See official notice, ‘Notice of Exclusion’ list of dismissed Plaintiffs or download directly from our FAQ page.
